Terms & Conditions

Please read these General Terms and Conditions (“Terms”) carefully. By using the Motorbike Rental Services (as defined below), you agree that you have read, understood, accepted and agreed with these Terms. You further agree that the representations below are true and accurate. If you do not agree to any of the terms and conditions stated herein and wish to discontinue using the Services, please do not continue using the services (as defined below).

1. Limitation of Liability

  • If the Company cannot provide the Motorbike Rental Services due to an occurrence of a Force Majeure Event, the Company shall be exempted from any obligations under these Terms.

  • The Company shall not be liable for any disruption in the use of the Motorbike Rental Services caused by any act or omission of the Member, including but not limited to improper handling of the motorbike, misuse of provided safety gear (helmet, jacket, gloves, etc.), or failure to comply with traffic laws.

  • The Motorbike Rental Services are provided by the Company on an “as is” and “as available” basis without any guarantees, conditions, or warranties. Unless expressly stated to the contrary and to the fullest extent permitted by law, the Company expressly excludes all conditions, warranties, and other terms which might otherwise be implied by statute, common law, or the law of equity. The Company shall not be liable for any damages whatsoever, including, but without limitation, to any direct, indirect, special, consequential, punitive, or incidental damages, or damages for personal injury, loss of life, use, profits, data or other intangibles, damages to goodwill or reputation, damages to personal belongings, or the cost of procurement of substitute goods and services, arising out of, or related to the use, inability to use, performance, or failures of the motorbike, protective gear (helmet, jacket, gloves, raincoat), and any materials, information, data, and facts posted by the Member or other members thereon, irrespective of whether such damages were foreseeable or not.

  • Without prejudice, the Company’s liability (if any) shall be capped at the total Rental Fees paid by the Member to the Company in the preceding 30 days of the date of the damage suffered.

  • The Company shall not be liable for any transactions, dealings, or arrangements between the Member and any third party obtained through the Motorbike Rental Services, including but not limited to roadside repair providers, fuel stations, or external insurance coverage.

2. Motorbike should not be used for the purposes stated below :

  • For any illegal or unlawful purposes under the laws of Malaysia.

  • For any morally objectionable purposes.

  • In contravention with these Terms.

  • In a manner which will cause damage to the motorbike, including the body, engine, tyres, seat, helmets, jackets, or any safety equipment provided by the Company.

  • To be ridden to a place outside of Malaysia or another island. Example: Singapore, Thailand, Labuan, Langkawi, Sabah, Sarawak, Tioman, Redang, Pangkor, etc. It is strictly prohibited to ride on a non-gazetted road, dirt road, trail, or off-road terrain, or to transport the motorbike by boat or ship without written approval from the Company.

  • For any commercial or non-personal purposes, including providing delivery services, ride-hailing, courier, or ridesharing, unless prior approval of the Company is obtained.

  • For any other purpose of which the Company is of the view that it may cause damage or harm to the Company and/or the public.

  • To smoke or use electronic cigarettes while riding or handling the motorbike.

  • To transport pets in a manner that may damage the motorbike or safety gear.

  • To carry durians, raw meat, or any strong-smelling or spillable items that may damage the motorbike or gear storage compartments.

  • To forge, cover, or tamper with the license plate, road tax, or any identification features of the motorbike.

  • To perform acts that will infringe or jeopardize the Company’s ownership of the motorbike, including, without limitation, sub-renting, pledging as collateral, or attempting to sell the motorbike.

  • To tow, push, or pull other motorbikes, vehicles, or heavy objects.

  • To store, transport, or conceal drugs, explosives, or any other illegal objects using the motorbike or the compartments (if any).

  • To remove, replace, or damage any part(s) of the motorbike, including but not limited to the road tax, GPS tracker, security device, helmet lock, or any other items installed by the Company.

  • To carry more than the maximum number of riders allowed, which is strictly limited to the rider and one (1) passenger, in accordance with the law and the motorbike’s approved seating capacity.

  • To sublet or hire the motorbike to any other person.

  • To permit the motorbike to be operated by anyone not authorized under the rental agreement.

  • To operate the motorbike, or permit it to be operated, in any race, rally, speed test, stunt activity, or contest.

  • To operate the motorbike in breach of the Malaysian Road Transport Act 1987, including carrying more passengers or exceeding the weight limit specified for the motorbike.

  • To ride or permit the motorbike to be ridden by any person not stated in the rental agreement, or by anyone who is not the holder of a valid and current motorcycle driving license appropriate for the class of motorbike.

3. Returning of the Motorbike

  • The Renter shall, at or before the expiry of the term of hire, return the motorbike to the location stated in the rental schedule, or obtain the Company’s consent to continue the hire. (Note: No refund is available to the Renter if the motorbike is returned earlier than stated in the schedule).

  • The motorbike must be returned in a clean condition together with all safety gear provided (helmet, jacket, gloves, raincoat, etc.) and in good working order. A cleaning penalty fee of RM500.00 will be charged if there is evidence of cigarette ashes, smoke odour, or other unpleasant odours or stains on the motorbike or the safety gear provided.

  • The motorbike must be returned with the same fuel level as when it was collected, in accordance with the fuel-to-fuel policy. An administration fee of RM20.00 will apply in addition to the cost of fuel if the motorbike is returned with less fuel than at collection. If the motorbike is not returned to the agreed location, a relocation administration fee of RM1,000.00 will be charged for the Company to collect the motorbike.

  • There is a grace period of 45 minutes for the return of the motorbike. If the Renter returns past 45 minutes, an hourly late return fee will be charged depending on the motorbike make and model. The Renter must notify the Company at 011-8888 7527 at least 24 hours before the return date and time if they wish to extend the rental period. Penalty fees will be imposed if the extension request is made within 24 hours or less before the scheduled return.

4. Security Deposit

  • The Security Deposit acts as a guarantee of proper usage of the motorbike and the provided safety gear (helmet, jacket, gloves, etc.) for the entire duration of the rental period.

  • The security deposit amount will vary according to the make and model of the motorbike. The deposit amount will be charged upon confirmed reservation/booking together with the payment of the motorbike rental fee.

  • Upon returning the motorbike and safety gear in the same condition as how they were collected, with no summon tickets from any government authorities, and with no damage whatsoever to the rented motorbike or provided gear, the deposit will be fully refunded immediately upon returning of the motorbike for FOREIGN CLIENTS. For LOCAL CLIENTS, the security deposit will be refunded within 7–14 working days to ensure that there are no outstanding damages, summons, or penalties incurred during the rental period.

  • If damages, missing items, or summonses are found, the full deposit will be forfeited to cover the costs. If the damages or penalties exceed the deposit amount, the Company reserves the right to demand the excess amount from the Renter. The Renter will also bear any additional costs if necessary. Motorbike rental fees and the security deposit must be fully paid upon collection of the motorbike.

5. Breach of Contract

  • The Company shall have the right to terminate the Renter’s agreement and take immediate possession of the motorbike, including any safety gear provided (helmet, jacket, gloves, raincoat, etc.), if the Renter fails to comply with any terms and conditions of this agreement, or if the motorbike is damaged, misused, or suspected to be involved in any illegal activities or other suspicious conduct.

  • The termination of the hire under the authority of this clause shall be without prejudice to the other rights of the Company and the rights of the Renter under this agreement or otherwise.

6. Rental Charges

  • The charges are calculated based on a 24-hour period from the commencement of the Rental Period for Daily and Weekly rentals. A monthly rental is calculated based on the calendar month. Daily rental rates will be applied for rentals below 7 days. Weekly rental rates will be applied for rentals of 7 days and above. If the rental is more than 14 days, the daily or monthly rate will be calculated based on the number of days. In relation to monthly rentals, any extension of the rental period will be prorated based on the calendar month.

  • If your motorbike rental usage time is less than 24 hours, you will still be charged for the full one-day rate. However, if your motorbike rental usage time exceeds the 24-hour cycle, you must pay the full-day rental fee and additional hourly rate. Your total rental rate is calculated based on the information provided at the time of reservation. There is no rebate or refund for early return.

  • No cancellation is allowed within 24 hours after a booking is confirmed; otherwise, the full booking fee will be forfeited. If the booking is cancelled on the day of pickup or in the event of a no-show, then 100% of the gross rental will be charged and forfeited.

  • Selected motorbikes may come with a capped daily mileage limit of 200 km depending on the number of days rented.

  • Additional mileage excess charge will be between RM0.20 – RM1.00 per kilometer (depending on the make and model of the motorbike).

7. Rates DO NOT INCLUDE or COVER the following items :

  • Cleaning : The Renter is liable for all cleaning charges if the motorbike is returned in a dirty condition beyond normal use. This includes stains, unpleasant odours, or damage to the seat, storage box, helmet, or jacket provided by the Company.

  • Damages : The Renter is liable for all damage to the motorbike body, paint, mirrors, handles, switches, meters, lights, tyres, or any other parts and fittings of the motorbike caused by negligence, misuse, or events not considered normal usage.

  • Missing, Stolen, Broken, or Damaged Accessories : The Renter is liable for the full replacement cost of any missing, stolen, or broken accessories during the rental period or upon return of the motorbike, unless the items were damaged at the same time as the motorbike in an accident. Examples include: helmet, jacket, gloves, raincoat, storage box, side mirrors, phone holder, USB port, first aid kit, motorbike tools, lock, signal lights, headlamp, rear lamp, number plate, and other supplementary parts.

  • Lost or Damaged Keys : The Renter is liable for all replacement costs of lost or damaged motorbike keys, which may include a new set of keys, immobilizer, security system, and related items.

  • If the Renter is found to have breached the above conditions, the Renter shall be liable for all expenses incurred, including repair, replacement, or additional cleaning costs.

  • The Company shall not be liable for any missing, stolen, or broken personal items belonging to the Renter during the rental period, or during servicing and maintenance. Renters are strongly advised to remove all valuable belongings when returning the motorbike. Examples include: laptops, watches, sunglasses, wallets, cash, Touch ’n Go card, smart tags, mobile phones, shoes, or other personal belongings.

8. Speed Limit Advisory

The Renter shall not ride the motorbike at a speed exceeding 110 km/h. For every notification received from the Company’s speed limit tracker or monitoring system indicating that the motorbike has been ridden beyond the permitted speed limit, a penalty charge of RM100 will be imposed on the Renter/Rider.

9. Prohibited of Use of Motorbike

  • The Company shall have the discretion to report or notify the competent authorities if the motorbike is used for, or if the Company has reason to believe that the motorbike is being used for, prohibited purposes other than the permitted use under this Agreement.

  • If the Renter is found to have breached the conditions mentioned herein, the Renter shall be liable for all expenses incurred, including but not limited to repairs to the motorbike body, frame, engine, exhaust, tyres, or electrical parts, as well as replacement or cleaning of helmets, jackets, gloves, storage boxes, or any other safety gear provided by the Company.

  • The Company reserves the right to refuse or terminate services to any Renter who contravenes this Article.

10. Parking Fees & Toll Charges

All parking fees, toll charges, and related road usage fees shall be fully borne by the Renter. The Renter shall use their own cash, Touch ’n Go (TNG) card, or any other accepted payment method to settle these charges. A TNG card may be provided by the Company upon request, but the responsibility for ensuring sufficient balance and proper usage remains with the Renter.

11. In Case of Accident 

  • If the Vehicle is involved in an accident, sustains damage, breaks down, or requires repair or salvage—regardless of cause—the Renter must immediately notify the Company by Call/WhatsApp at 011-8888 7527, providing full details of the incident along with pictures of the damages, the Vehicle, and the surrounding area. If the Vehicle is involved in an accident, the Renter must also lodge a police report within 24 hours and await further instructions from the Company.

  • Any towing, recovery, or related services must be authorized by the Company in advance. The Renter must first contact 011-8888 7527 for approval before engaging any third party.

  • The Renter shall not arrange or undertake any repairs or replacements (including but not limited to tyres, batteries, or spare parts) without the Company’s prior authorization, except where immediate action is required to prevent further damage to the Vehicle or other property. In such cases, the Renter must retain and provide the official receipt to be eligible for reimbursement. Claims without receipts will not be reimbursed.

  • Please note that the insurance coverage applies only to the Vehicle and does not extend to the Renter, pillion riders, or third-party passengers.

  • ⚠️ Important : Failure to take responsibility for the accident, lodge a police report, or comply with the reporting procedures outlined above will result in an administration fee of a minimum RM500, in addition to any other charges or liabilities incurred.

12. In Case of Fines / Summons

  • All penalties, fines, or charges related to traffic and/or parking offences issued by JPJ, PDRM, Traffic Police, or any other relevant enforcement authorities shall be the sole responsibility of the Renter.

  • The Company reserves the right to recover such charges from the Renter by:

  • Deducting from the security deposit;

  • Charging the Renter’s credit/debit card; or

  • Requesting payment via cash or online transfer for any outstanding amounts.

  • The Renter agrees to:

  • Forward a copy of any summons, fine, or official notice received to the Company as soon as possible.

  • Provide all necessary information to the relevant enforcement authority so that the offence is properly directed to the Renter.

  • Bear full responsibility for any fines, summonses, or penalties incurred during the rental period.

  • The Renter maintains the right to query, object to, or contest any alleged offence with the issuing authority and may request a court hearing if desired.

  • ⚠️ Important : If the Company is required to settle a summons on behalf of the Renter, an administration fee of RM100 will be charged in addition to the fine amount.

  • 📌 Traffic Law Reminder (Malaysia) :

  • Highways : Maximum speed limit 110 km/h

  • Federal & State Roads : Maximum speed limit 90 km/h

  • The Renter must drive responsibly and obey all traffic laws. Failure to comply may result in fines, penalties, and additional charges.

13. In Case of Stolen Motorbike

  • The Renter is fully responsible for the safekeeping of the vehicle during the rental period. This includes ensuring the vehicle is:

  • Parked in a safe and secure location; and

  • Properly locked and secured at all times.

  • If the vehicle is lost or stolen, the Renter must:

  • Take pictures of the surroundings and location where the vehicle was lost or stolen.

  • Immediately contact the Company at 011-8888 7527.

  • Lodge a police report within 24 hours of the incident.

  • In the event of theft or total loss of the vehicle, the Renter shall be responsible for:

  • Settling any outstanding monthly instalment payments of the affected vehicle directly with the bank (if applicable); and

  • Covering loss of usage charges as determined by Rent N Ride.

14. In Case of Involving in Illegal Activities

  • The Renter is strictly prohibited from using the vehicle for any illegal purposes under Malaysian law. This includes, but is not limited to, the transportation, delivery, or possession of :
    > Drugs or controlled substances ;
    > Weapons ;
    > Contraband ;

  • Any other items or activities prohibited in Malaysia.

  • If the vehicle is used for any illegal activity, the Company will :

    > Provide full cooperation and disclosure to the Royal Malaysia Police (PDRM) and Malaysian courts.

    > Immediately terminate the rental agreement and repossess the vehicle.

    > All legal liabilities, criminal charges, fines, penalties, and other consequences arising from such illegal use will be the sole responsibility of the Renter.

15. Persons who may Drive

  • The vehicle may only be driven during the rental period by the person(s) named in the Vehicle Rental Agreement, subject to the following conditions:
    1.  The driver must be at least 21 years of age at the time of rental.
    2. The driver must hold a valid Malaysian driving license (Class B/B2) or a valid International Driving License/Permit (IDL/IDP), accompanied by their          original passport or identity card.
    3. All driving licenses must be in English, or accompanied by an authorized English translation.
    4. The original driving license must be presented at the time of vehicle collection.
    5. Probationary (P) or Restricted licenses are not accepted.

  • Only drivers who meet the above requirements and are registered in the rental agreement are legally permitted to operate the vehicle. Any unauthorized driver will be considered a breach of contract and may result in immediate termination of the rental.

16. Payment by Renter

  • The Renter shall pay the Company in full prior to motorbike dispatch, covering the rental fee for the agreed period as specified in the schedule, including the required security deposit.

  • Accepted payment methods include Credit Card, Debit Card, Online Bank Transfer, QR Pay, or Cash.

  • The Renter agrees to pay any additional costs incurred during the rental period, including parking, toll, speeding, and traffic fines.

  • The Renter is liable for costs related to motorbike damages, puncture or tyre repair.

  • The Renter is liable for relocation, cleaning, and administration fees when applicable.

  • Additional costs may be charged during or after the rental period if they become apparent following the termination of the hire.

  • The Renter shall return the motorbike with the same fuel level as collected.

  • If the fuel level is lower, an administration fee of RM20 will be charged in addition to the cost of the fuel.

  • In addition to the rental payment, the Renter shall pay the Company the insurance fee as specified in the rental agreement.

  • The Renter authorizes the Company to charge any outstanding sums to their Credit Card, Debit Card, or collected Cash deposit if necessary.

17. Vehicle Insurance

  • Third party insurance coverage is included in the quoted rental rate, underwritten by AXA Affin Insurance or Great Eastern General Insurance Berhad (Malaysia).

  • Third party insurance only covers damage to third-party vehicles or property in the event of an accident.

  • Third party insurance does not cover the Renter, passengers, tyres, helmets, riding gear, scratches, dents, exterior, undercarriage, or single-vehicle accidents.

  • In the event of damage, theft, or total loss of the rented motorbike, the Renter is fully liable for the full cost of repair or replacement of the motorbike.

  • The Renter is also liable for loss of usage fees as determined by Rent N Ride during the repair or replacement period.

18. Collection of the Vehicle

  • The Renter must bring a photocopy of their identity card or passport, valid driving license, business card, or any relevant document to verify their home or working address.

  • During vehicle collection, the Renter is required to inspect the motorbike for any damages or missing parts.

  • Any unreported damage or missing part discovered later will be considered the Renter’s responsibility.

19. Helmet, Jacket, Gloves and Safety Suit Rental 

  • Helmet Rental : Standard helmet at RM10 per rental, or sport helmet at RM20 per rental (helmets are compulsory by Malaysian law).

  • Riding Jacket Rental : RM15 per jacket per rental, subject to pre-booking.

  • Gloves Rental : RM15 per pair per rental, subject to pre-booking.

  • Safety Suit Rental : RM80 per suit per rental, subject to pre-booking.

  • Any missing, lost, or damaged helmets, jackets, gloves, or safety suits will incur a replacement charge of RM500 per item.

20. Delivery & Collections Fees 

  • Delivery and collection fees will be charged based on the distance and calculated on a per-trip basis.

  • An additional charge of RM50 applies for delivery and collection made before or after office hours.

  • If the Renter chooses delivery, the motorbike must be returned directly to the Company’s location at the end of the rental for inspection and verification of its condition.

21. Additional Passenger

  • An additional passenger (pillion) is allowed without extra rental charges.

  • The passenger must wear a helmet at all times in accordance with Malaysian law.

  • The Company is not liable for any injury, damage, or loss involving the passenger, as insurance coverage only applies to the rented motorbike and third-party property.

  • The Renter bears full responsibility for the safety and conduct of any passenger carried on the motorbike.

22. Long-Term Rental / Leasing

  • For commercial or business use, Company SSM details are required for verification purposes.

  • The Renter is responsible for returning the motorbike to the Company for servicing when due. A penalty of RM2.00 per KM will be imposed after exceeding 500KM beyond the service limit.

  • For rentals of 3 months and above, a one-month security deposit is required.

  • Monthly rentals will be billed on the first calendar day of each month for contracts of 2 months and above.

  • In the event of late payment, an interest charge of 10% per month will be imposed.

  • The deposit cannot be used to pay for future monthly rentals.

  • Early termination of rentals of 3 months and above is not permitted. The Company reserves the right to recover the rental for the unexpired term of the agreement

23. Motorcycle Key Missing

In the event of a missing motorcycle key during the rental period, the Renter will be fully responsible for all associated costs. If the motorcycle requires servicing at an authorized service centre due to the missing key, Rent N Ride will calculate the pro-rated rental charges for the days the motorcycle is unavailable, based on the rental rate.

  • If the Renter requires assistance with pickup or delivery of the motorcycle to or from the service centre, a fee of RM100 will be charged per trip.

  • A replacement fee of RM500 will apply for a missing or lost motorcycle key.

24. Prohibited Use - Transporting Heavy or Excessive Loads

  • Renters are strictly prohibited from using rental motorcycles to transport large or heavy goods, including but not limited to furniture, appliances, parcels for relocation, or items exceeding the motorcycle’s designated weight capacity.

  • The Renter must ensure that the motorcycle is not overloaded or misused in a way that compromises safety and performance. Any damage caused due to overloading, improper use, or carrying excessive cargo will be the full responsibility of the Renter, including repair costs and loss of usage.

  • If the motorcycle is found to be used for such prohibited purposes, Rent N Ride reserves the right to immediately terminate the rental agreement without refund. The Company also reserves the right to inspect the motorcycle at any time to ensure compliance with this policy.

25. Cross-Border Restrictions

  • The rented motorcycle must remain within Malaysia at all times during the rental period. Crossing international borders, including but not limited to Singapore, Thailand, Brunei, or Indonesia, is strictly prohibited without the Company’s prior written approval.

  • If the motorcycle is taken outside Malaysia without authorization, the Renter will be subject to :
    A penalty fee of RM5,000.
    Immediate termination of the rental agreement with no refund.

  • Full liability for any damages, losses, or legal issues resulting from unauthorized cross-border travel.

27. Motorcycle Towing

  • In the event that the motorcycle is towed due to the renter’s irresponsible actions, such as improper parking, traffic violations, or illegal use, the renter will be fully responsible for all associated towing and penalty costs.

  • If the renter requires the Company’s assistance to retrieve the motorcycle, a minimum service fee of RM100 will be applied in addition to any towing or related charges.

28. Third Party Restrictions

  • Only the renter whose name is stated in the rental agreement is authorized to collect and operate the motorcycle. No third parties, including family members, friends, or acquaintances, are permitted to act or collect the motorcycle on behalf of the renter.

  • If a third party attempts to collect the motorcycle, the booking will be automatically cancelled, and any deposits or booking fees paid will be forfeited.

29. Zero Tolerance for Abusive Behaviour

  • Rent N Ride is committed to maintaining a safe, respectful, and professional environment for both staff and customers. The Renter must behave respectfully at all times towards Rent N Ride employees, representatives, and affiliates, and must refrain from any form of verbal abuse, written threats, physical intimidation, harassment, or abusive behaviour.

  • Any violation of this clause will be treated as a serious breach of the rental agreement. Rent N Ride reserves the right to immediately terminate the rental agreement without notice or refund, deny current or future rental services, remove the individual from the premises (if applicable), and pursue legal action where necessary.

  • By signing this agreement or proceeding with the rental, the Renter acknowledges and agrees to comply fully with this policy.
